RENUNCIA DE RESPONSABILIDAD Y ACUERDO DE INDEMNIZACIÓN
I. NOTIFICACIONES DE RIESGO
Reconozco por la presente que Wellzense, PLLC (“Wellzense”), una sociedad de responsabilidad limitada de Arizona, opera un estudio holístico/bienestar en línea que ofrece los siguientes servicios: (incluyendo pero no limitado a: diferentes estilos de yoga (por ejemplo, Yin Yoga, Yoga Restaurativo, Yoga Nidra, Yoga Terapéutico, Hatha Yoga, Yoga Suave, Yoga Somático, Yoga en Silla, Yoga Informado sobre Trauma, Yoga de Pared), respiración consciente, prácticas de meditación, prácticas de sanación con sonido, movimientos somáticos (por ejemplo, Liberación Miofascial, Ejercicios para la Liberación de Trauma y Tensión (“TRE”), movimientos de meditación, clases magistrales sobre temas relacionados con la salud mental como el manejo del estrés, la ansiedad y el agotamiento). A cambio de dichos servicios de membresía ofrecidos, y al aceptar unirse a Wellzense, por la presente acepto este acuerdo de renuncia de responsabilidad y exención de responsabilidad (“Acuerdo”). Es expresamente entendido que estoy obteniendo la membresía en Wellzense de manera voluntaria con pleno conocimiento de todos los riesgos y/o lesiones que puedan atribuirse a los tipos de servicios ofrecidos. Asumo y acepto todos los riesgos para mi seguridad, salud y bienestar durante el curso de mi membresía y en perpetuidad después de la misma. Reconozco que Wellzense no puede garantizar el riesgo contra lesiones durante mi membresía en cualquier capacidad. Acepto cumplir con todos los avisos, advertencias, reglas y regulaciones en lo que respecta a mi membresía con Wellzense.
La información y recursos proporcionados no tienen la intención de ofrecer diagnóstico o tratamiento, ni de interferir o reemplazar los servicios de sus proveedores médicos o psicológicos. Al convertirse en Miembro, reconoce y comprende que cualquier membresía con Wellzense no establece de ninguna manera una relación o privilegio de consejero o terapeuta con Wellzense. Wellzense no garantiza que ningún miembro será sanado o cambiado por el uso de sus servicios. Wellzense no ha hecho garantías sobre los resultados de tomar cualquier acción, ya sea recomendada en este sitio web o no. Wellzense proporciona recursos informativos destinados a ayudar a sus miembros. Usted como miembro, no obstante, reconoce que su éxito o fracaso final será el resultado de sus propios esfuerzos, de su situación particular y otras innumerables circunstancias más allá del control y/o conocimiento de Wellzense. II. AUTORIZACIÓN MÉDICA
He consultado a un médico de mi elección y se me ha informado que estoy en buen estado de salud. Mi médico confirmó que no sufro de ninguna dolencia física o mental que me impida obtener la membresía en Wellzense, o que cause lesiones o muerte como resultado de mi participación en tales servicios. En caso de experimentar algún peligro, lesión, incapacidad o enfermedad, utilizaré mis mejores esfuerzos para contactar a mi asistencia de emergencia tan pronto como sea posible. Al utilizar este sitio web, acepta la responsabilidad personal por los resultados de sus acciones. Acepta asumir plena responsabilidad por cualquier daño o lesión que sufra como resultado del uso, o no uso, de la información disponible en este sitio web, obtener la membresía con Wellzense y el uso de cualquier servicio o producto de Wellzense, o los recursos disponibles para descargar desde este sitio web. Acepta usar un juicio prudente como lo haría una persona razonable y realizar la debida diligencia antes de tomar cualquier acción o implementar cualquier plan o política sugerida o recomendada por Wellzense.
III. RENUNCIA DE RESPONSABILIDAD E INDEMNIZACIÓN
En vista de lo anterior y en consideración a que se me permita ser miembro, yo, por mí mismo, mi cónyuge, mis herederos, mis ejecutores, mis administradores y mis cesionarios, en la medida en que sea legalmente permisible, libero y descargo para siempre a Wellzense y sus afiliados, predecesores, sucesores y cesionarios, y a todos sus respectivos pasados, presentes y futuros funcionarios, directores, accionistas, empleados y agentes, y sus respectivos herederos, ejecutores, administradores y cesionarios (en conjunto, los “Liberados”), de y contra cualquier reclamo que surja de o por motivo de cualquier lesión corporal, lesiones personales conocidas o desconocidas (incluido el trauma emocional), muerte o daño a la propiedad resultante o supuestamente resultante de cualquier accidente u otro episodio que pueda ocurrir, ya sea basado en la negligencia de, o el incumplimiento del contrato por parte de, cualquier Liberado o cualquier otra parte por cuyos actos cualquier Liberado pueda ser responsable en derecho o en hecho, o cualquier otra causa o principio de derecho, como resultado de mi participación como miembro de Wellzense o cualquier actividad relacionada con ello. El sitio web de Wellzense es un recurso público de información general que está destinado, pero no prometido o garantizado, que sea correcto, completo y actualizado. IV. DISPOSICIÓN DE ELECCIÓN DE LEY
Cualquier y todos los reclamos contra los Liberados, ya sea que surjan en contrato, agravio u otro cuerpo de derecho que surja bajo o relacionado de alguna manera con mi membresía con Wellzense, así como cualquier reclamo interpuesto por mí o cualquier persona que reclame un derecho derivado de mí contra Wellzense, serán presentados en la jurisdicción del condado de Maricopa, Arizona. Todos estos reclamos estarán regidos por las leyes del estado de Arizona sin tener en cuenta los principios de conflicto de leyes. Esta renuncia contiene el acuerdo completo entre las partes de este Acuerdo. Este Acuerdo reemplaza cualquier acuerdo anterior o contemporáneo, entendimiento o negociación con respecto a su tema. LIABILITY WAIVER AND HOLD HARMLESS AGREEMENT
Member hereby acknowledges that Wellzense, PLLC (“Wellzense”), an Arizona limited liability company does operate an online holistic/wellness studio offering the following services: (including but not limited to: different styles of yoga, (e.g. Yin Yoga, Restorative Yoga, Yoga Nidra, Therapeutic Yoga, Hatha Yoga, Gentle Yoga, Somatic Yoga, Chair Yoga, Trauma Informed Yoga, Wall Yoga), mindfulness breathing, meditation practices, sound healing practices, somatic movements, (e.g. Myofascial Release, Trauma and Tension Releasing Exercises (“TRE”), meditation movements, master classes on mental health related topics such as managing stress, anxiety and burnout). In exchange for such membership services offered, and by agreeing to join Wellzense, I hereby agree to this liability waiver and hold harmless agreement (“Agreement”).
It is expressly understood that I am voluntarily obtaining membership to Wellzense with a full understanding of all risks and/or injuries that may be attributable to the types of services offered. I assume and agree to accept all risks to my safety, health, and well-being during the course of my membership and in perpetuity thereafter. I acknowledge that Wellzense cannot guarantee risk against injury during my membership in any capacity. I agree to abide by all disclaimers, warnings, rules and regulations as it pertains to my membership with Wellzense.
The information and resources provided are not intended to provide diagnosis or treatment or to interfere or to replace the services of your medical or psychological providers. Becoming a Member acknowledges and understands that any membership with Wellzense does not in any way establish a counselor-client relationship or privilege with Wellzense. Wellzense does not guarantee that any member will be healed or changed from the use of its services. Wellzense has not made any guarantees about the results of taking any action, whether recommended on this website or not. Wellzense provides informational resources that are intended to assist members. You as a member, nevertheless, recognize that your ultimate success or failure will be the result of your own efforts, particular situation, and other innumerable circumstances beyond the control and/or knowledge of Wellzense. You as a member also recognize that results do not guarantee any similar outcome among members and that results obtained by other members of Wellzense are no guarantee that you will be able to obtain similar results.
I have consulted a physician of my own choosing and have been advised that I am in good health. My physician confirmed that I do not suffer from any physical or mental ailment which would prevent me from obtaining membership with Wellzense, or which would cause injury or death as a result of my participation in such services. In the event I experience any hazard, injury, incapacity, or illness, I will use my best efforts to contact my emergency assistance as soon as practicable.
By using this website, you accept personal responsibility for the results of your actions. You agree to take full responsibility for any harm or damage you suffer as a result of the use, or non-use, of the information available on this website, obtaining membership with Wellzense and the use of any services or products of Wellzense, or the resources available for download from this website. You agree to use prudent judgment as a reasonable person would do and conduct due diligence before taking any action or implementing any plan or policy suggested or recommended by Wellzense.
- RELEASE WAIVER AND HOLD HARMLESS
In light of the above and in consideration for me being permitted as a member, I do, for myself, my spouse, my heirs, my executors, my administrators, and my assigns, as far as legally permissible release and forever discharge Wellzense and its affiliates, predecessors, successors, and assigns, and all of its respective past, present and future officers, directors, shareholders, employees, and agents, and their respective heirs, executors, administrators, and assigns (collectively, the “Releasees”), of and from any and every claim arising from or by reason of any bodily injury, personal injuries known or unknown (including emotional trauma), death, or property damage resulting or alleged to result from any accident, or other episode that may occur, whether based on the negligence of, or the breach of contract by, any Releasee or any other party for whose acts any Releasee may be responsible in law or in fact, or any other cause or principle of law, as a result of my participation as a member of Wellzense or any activities connected therewith.
The Wellzense website is a public resource of general information that is intended, but not promised or guaranteed, to be correct, complete, and up to date. We have taken reasonable steps to ensure that the information contained in this website is accurate, but Wellzense cannot represent that this website is free of errors. You accept that the information contained on this website may be erroneous and agree to conduct due diligence to verify any information obtained from this website and/or resources available on it prior to taking any action. Furthermore, you expressly agree not to rely upon any information contained in this website.
Wellzense is not responsible for negligence or carelessness on the props (e.g. Yoga Blocks, Chairs, Straps, Yoga balls, and Bolsters) that are acquired through Wellzense. You hereby agree that you will be using any props in conjunction with the Wellzense platform at your own risk.
Any and all claims against the Releasees whether arising in contract, tort, or other body of law arising under or relating in any manner to my membership with Wellzense as well as any claim asserted by me or anyone claiming a right derived from me against Wellzense shall be brought in the jurisdiction of Maricopa County, Arizona. All such claims shall be governed by the laws of the state of Arizona without regard to conflict of law principles. This release contains the entire agreement between the parties of this Agreement. This Agreement supersedes any prior or contemporaneous agreements, understandings, or negotiations regarding it subject matter. This Agreement shall be interpreted and enforced in accordance with the laws of the state of Arizona and shall be as broad and inclusive as permitted by such laws. If any provisions of this Agreement are held invalid, it is agreed that all other provisions are not to be held invalid and shall continue in full force and legal effect.

I agree that this Agreement shall be binding on me and my spouse, executors, administrators, legal representatives, heirs, and assigns. I represent that I have read the foregoing and fully understand the meaning and effect thereof, and, intend to be legally bound by its terms.
